After outlining the concepts of Sovereignty and Digital Constitutionalism, pivotal to the current European "Regulatory Turn," we will delve into key elements of the European Digital Services Act (DSA). Through this analysis, we aim to evaluate the horizontal impact of the European Charter of Fundamental Rights on the "internal statute" of platforms through the lens of Article 14 of the regulation. If interpreted this way, it could unlock the potential for both "procedural" and "substantial" constitutionalization of the digital information ecosystem. We will also focus on the interplay between Article 14 and Article 53 to assess the possibility of extending the administrative complaint to the violation of fundamental rights by the terms and conditions of service.

Abstract
